Terms of Service — BreakHub

By creating an account or using the BreakHub platform ("Platform"), you agree to the following terms.




1. Definitions


  • Platform: the website and services provided by BreakHub.
  • Breaker: a user who lists and sells "breaks" (opening of collectible card packs) through the Platform.
  • Buyer: a user who purchases spots in breaks offered by a Breaker.
  • PIX: the instant payment system used for direct transactions between Buyer and Breaker.

  • 2. Nature of the Platform


    BreakHub acts exclusively as a technology intermediary, providing tools for Breakers to list, manage, and sell breaks.


    BreakHub does NOT:

  • Participate in financial transactions between Breaker and Buyer;
  • Receive, hold, or transfer funds related to the purchase of spots;
  • Guarantee the delivery, quality, or authenticity of cards;
  • Guarantee that listed breaks will be completed;
  • Provide custody, escrow, or buyer protection services.

  • 3. PIX Payments


    All payments are made directly between Buyer and Breaker via PIX. BreakHub only displays the PIX key registered by the Breaker and allows the Buyer to upload proof of payment for verification.


    BreakHub is not responsible for:

  • Payments sent to incorrect PIX keys;
  • Chargebacks, refunds, or payment disputes;
  • Fraud involving fake or tampered payment receipts.

  • 4. Breaker Responsibilities


    The Breaker is solely responsible for:

  • Completing the break as advertised;
  • Shipping cards to the Buyer(s) adequately and within the agreed timeframe;
  • Answering questions and handling complaints from Buyers;
  • Complying with all applicable laws, including tax and consumer protection obligations.

  • 5. Buyer Responsibilities


    The Buyer acknowledges that:

  • Purchasing spots involves inherent risk (there is no guarantee of which cards will be obtained);
  • They should verify the Breaker's reputation and track record before making any payment;
  • Any dispute regarding delivery, quality, or amounts must be resolved directly with the Breaker.

  • 6. Limitation of Liability


    To the fullest extent permitted by law, BreakHub shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from:

  • Default, fraud, or bad faith by any Breaker or Buyer;
  • Loss of funds transferred via PIX;
  • Non-delivery, loss, or damage of cards;
  • Interruption, suspension, or unavailability of the Platform.

  • 7. Conduct and Account Termination


    BreakHub reserves the right to suspend or terminate accounts of users who violate these Terms, engage in fraud, submit fake payment receipts, or engage in conduct that harms the community.


    8. Intellectual Property


    All Platform content (code, brand, design, text) is the property of BreakHub. Use of the Platform does not grant the user any rights to the brand or intellectual property.


    9. Changes to Terms


    BreakHub may modify these Terms at any time. Significant changes will be communicated through the Platform. Continued use after publication of changes implies acceptance of the new Terms.


    10. Governing Law


    These Terms are governed by the laws of the Federative Republic of Brazil. Any disputes will be resolved in the courts of BreakHub's domicile.
